Blocked Executive Orders
Freezing Federal Funds
- What: Trump stopped $2B foreign-aid reimbursements for work already done (before Feb. 13). He instructed, "immediately pause new obligations and disbursements of development assistance funds to foreign countries."
- Plaintiffs (The People): People who either receive or have members who receive foreign aid funds, said freezing the funds was unconstitutional because Congress had already approved it, citing the Impoundment Control Act of 1974. "may have to shutter organizations if the agreed-upon funds are not paid.
- Defense (The Government): Acting Solicitor General Sarah Harris claims forcing fund dispersal effectively:
- allows a single federal district court to supervise the federal government’s contracting decisions regarding foreign aid—an area where the Executive Branch ordinarily has the broadest discretion.”
- Ali (the Federal Judge) did not have the power to issue such an order, because claims “that the government owes money under its contracts and other funding instruments” can only be brought in an entirely different court, the Court of Federal Claims.
